Think of this page as a collection of ground rules that apply to everything that happens here, at Anna Grunduls Design. The terms and conditions below apply to all transactions made in the Anna Grunduls Design shop.
These Terms also specify what you can do here and some bad things you cannot do, applying to all visitors of the website.

The Who

Anna Grunduls Design is the company responsible for the sale and order fulfillment as well as maintenance and ownership of annagrunduls.com.

The What

To put it simply: I create intricate illustrations, also known as adult coloring pages and turn them into practical stationery – such as (but not limited to) posters, stickers, postcards and home decor. All of these items are listed for sale in the shop section of this website.

annagrunduls.com is my place on the internet, where I: (1) run my online shop Anna Grunduls Design, (2) blog about the work as an illustrator and business owner, (3) occasionally share affiliate links to products and services I recommend, (4) sell advertising space, under a strict curation.

The Words and Definitions

Terms – This document is called “Terms and Conditions, Terms of service”, but to make it readable, I will simply refer to it as “terms”.

Terms and Conditions (pl. Regulamin) document in understanding of Polish Constitution
(art. 8 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz.U. z 2002 r. Nr 144, poz. 1204 ze zm.)).

Buyer – person or company, that places an order in the Anna Grunduls Design shop on terms described in this document.

The buyer must be a person or company able to perform legal actions.

Seller – me (Anna Grunduls) or Anna Grunduls Design in general. The company is responsible for fulfilling orders places on the website, according to the terms below.

The Company – Anna Grunduls Design (unless specified differently)

Product – Items described on the website and offered for sale.

Additional service – service not described or listed for sale on the website, that I may provide on buyer’s request, related to offered products.

Sales Agreement – the contract between the seller and buyer, result of order placement.

In understand of Polish law (ustawa Kodeks Cywilny)

Shop – the shop section of Anna Grunduls Design, where you can place orders online.

Order – buyer statement of intent. It specifies which products have been purchased and in what quantities. Leads directly to a sales agreement.

First Things First: The General Rules

The Terms specify all rules of using the Anna Grunduls Design shop and website. To place an order in the Anna Grunduls Design shop, you’ll have to agree to these Terms. Checking the box means you read and accept all of them (even if you didn’t really read the whole thing).

I did my best to write these Terms in a simple language and included some not-so-serious paragraph titles to make them more interesting, but that doesn’t make this document any less official. Please take these Terms very seriously.

Anna Grunduls Design is an online shop, which means you need an internet connection and a valid email address to place orders.

Products offered in the Shop are new, packaged and inspected for any damages by the Seller, legally enrolled in the Polish market. Not all of these products have barcodes or ISBN numbers. Most are considered artworks or handmade items and don’t require identification numbers.

The Bad Things You Cannot Do Here

I’m really excited to have you here and I trust that this is obvious to you, I really do. But the internet is a place dangerous like any other, so while you use this website, there are a few things I don’t allow:

  • Don’t post spam in the comments or product reviews.
  • Don’t try to install viruses here or hack this website or computers connected to it.
  • Don’t post comments or reviews unrelated to the website’s content.
  • Don’t be a robot. Not all robots are evil, but I’m not fond of internet bots, so please… don’t.
  • Don’t use the comments or reviews to post or promote content that discriminates, defrauds, hates or generally treats someone else badly.
  • Don’t share data or information you don’t have permission for.
  • Don’t post things I might find offensive or inappropriate, which is up to me.
  • Don’t use your order or our communications to send me any content restricted by Polish or international law. Basically, don’t send me anything that’s hurtful, discriminating, breaching anyone’s personal rights or other rights.

Please follow the rules. If you don’t, I’ll have to ban you from the website, remove your account or take legal action against you. If I fail to enforce these rules for any person, it is not a waiver to enforce my rights at any time for the same or different offenses.

The Orders

I use American Dollars (USD) to set product prices, but it’s also possible to display them and pay in Polish Zloty (PLN).

For conversions into Polish Zloty (PLN), I’m using WebServerX as the exchange rate provider. The rates are updated on a weekly basis and it happens automagically (they’re not set manually). Product prices are than rounded up to end in .99. If you’re not happy with the exchange rate used, you can always change back to USD and check our in the Shop’s original currency.

Both retail and wholesale orders can be placed in the Shop. Anyone can place a retail order and you don’t need an account for that. However, to place a wholesale order, you’ll need to be a registered and approved Wholesale Customer.

Orders can be placed anytime – 24/7, 7 days in a week, all days in the year, including public holidays.

You have successfully placed your order, if you filled in the checkout form correctly (including precise shipping address and email address) and your payment has cleared. Orders for which no payment has been made, don’t qualify for fulfillment.

Buyer is responsible for providing valid data, especially the shipping/billing address. As long as the order hasn’t shipped, I’m happy to correct any of the order data, however after the order is fulfilled, I don’t take responsibility for any issues with delivery or documentation of the order. If it’s impossible to fulfill the order because of incomplete or invalid data, I may cancel the order without prior notification.

In process of placing an order, Buyer may request a receipt or invoice. This agreement authorizes Anna Grunduls Design to issue a digital invoice.

According to Polish law: Rozporządzenie Ministra Finansów z dnia 20 grudnia 2012 r. w sprawie przesyłania faktur w formie elektronicznej, zasad ich przechowywania oraz trybu udostępniania organowi podatkowemu lub organowi kontroli skarbowej.

When placing an order, you automatically agree for Anna Grunduls Design to store and process your personal data in order to fulfill our Sales Agreement and to keep for legal reasons, such as tax records. Buyer has every right for insight into his own personal data, changing it or requesting a removal (unless it’s legally impossible). To learn more about how I protect your data, check out this section about Privacy Policy.

Even as a retail customer, you can create an account on the Anna Grunduls Design website, that gives you easier access to your personal data and simplifies future order placement. To create an account, click here. You need a unique username and password. I don’t have access to your password and it should remain private at all times.

After successful order placement, an email confirmation is sent to the Buyer’s email address. If you didn’t receive a confirmation email, make sure your payment has cleared and you entered a valid email address when placing the order. Some email providers may wrongly mark it as spam, so check these folders, where all your unsolicited emails go.

The turnaround time for an order starts once the payment has cleared and ends once the order is shipped out. The standard turnaround time is 1-3 business days.

The Shipping

Purchased products will be sent at the address you indicate at the checkout. If the checkout form was filled in incorrectly, it may cause delays or other issues with delivery, so please – double check your shipping address before finalizing the payment. If you knew, you could save yourself from a lot of trouble in just 2 seconds, you would definitely do that, wouldn’t you? Just go ahead an make sure your address is up to date.

So what if you already placed your order and realized your address was wrong after the order was sent? Well, let me know as fast as you can. Please note: If you change your shipping address in your account, it won’t change your address in the order. Message me directly, it’s the only way for me to fix the order data.

In the case you realized your shipping address is wrong after the order has been sent, I’m not responsible for correcting the address. But of course – I’d love to help you out, so don’t hesitate to reach out and I’ll see if it’s possible to forward your package to the right address. Should there be any additional charges for this service, you’ll be asked to cover them.

All ready to ship products ship within 1-3 business days of order placement (counts from the moment your payment clears). I sometimes offer products, that are only made on order. These ship within 5-7 business days. Final delivery date depends on the shipping method you choose.

Shipping must be paid for at the time of order placement. You can calculate the shipping costs at the cart page.

For shipping, I generally use Poczta Polska (the Polish National Postal Service), but I may also use FedEx or InPost for some deliveries.

The Payments

First of all, no matter which payment method you’ll use to place your order, I will always issue a receipt or invoice for you.

There are various payment methods you can use in the Anna Grunduls Design shop:

These providers keep your payment information secure. I cannot access your credit card information or collect unauthorized payments. Please do not send me your credit card data or other bank information via email or live chat.

The Wholesale Program

In addition to the retail online Shop, it’s also possible to place wholesale orders at Anna Grunduls Design. I created a robust retailer-friendly program to work with stockists all over the world.

In order to make a wholesale purchase in the Shop, you’ll need to register as a Wholesale Customer. For reasons that are purely technical, it’s impossible to access the linesheet or place wholesale orders without a Wholesale Customer account. It also gives me the opportunity to review potential stockists and improve your purchase experience.

The shipping times and methods of wholesale orders may vary from the shipping times offered to retail customers. Orders up to 2000 items usually ship within 5 business days. Shipping times of bigger and custom orders will be set for each order separately.

For wholesale discounts to apply, Wholesale Customers must meet the minimum total of $50, otherwise retail prices will apply. To qualify for wholesale discounts, buyer must purchase at least 3 copies of the same item.

Wholesale discounts are calculated on a category basis. This means, to receive the discount for 100 or more coloring posters, you have to add at least 100 items from the posters category to your cart. These can be various items – as long as the general quantity is right, your discounts will be applied.

The Additional Things I Do For Wholesale Customers

I want our wholesale collaboration to be beneficial for both you and Anna Grunduls Design, so I’m excited to help you with the sale of my products. If you’re a stockist, there are also additional return policies you can take advantage of: Defective products may be returned for full refund within 14 days of delivery. Unsold products in their original condition may be returned at buyer’s expense within 45 days of delivery, subject to a 10% restocking fee.

The Sales Agreement Withdrawal

Did you know, you can withdraw our Sales Agreement within 14 days from the date you received your items? No hard feelings, no questions asked.

To use your right to withdrawal, simply send the ordered items back no later than 14 days after you received them and make sure to let me know about your decision via email at customer-care@annagrunduls.com. This last part is very important – I won’t be able to accept your withdrawal, unless you notify me about it within the 14-days-time-frame, ok? Also important: the time frame is impassable. For example: If you received your order on April 1st, the last day you can ship it back is April 14th. On April 15th, your right to withdrawal is no longer valid.

According to Polish law: art. 7 ust. 1 ustawy z dnia 2 marca 2000 r. o ochronie niektórych praw konsumentów oraz o odpowiedzialności za szkodę wyrządzona przez produkt niebezpieczny Dz.U. Nr 22, poz. 271 ze zm.

In case of Sales Agreement Withdrawal, the agreement is considered never placed. It will be marked as cancelled within the ordering system and all receipts issued for this order will be cancelled as well.

To use the right of withdrawal, you’ll have to return the items in an unchanged condition. It means, they must be in their original, unopened packaging – exactly like you received them. Once you open the packaging or use the products, the right no longer applies.

Shipping charges for the return have to be covered by the buyer.

Some of my items are non-refundable. In the case of the Anna Grunduls Design shop, it’s the following:

  • Made to order products
  • Custom illustrated products
  • Ongoing commissions
  • Highly reduced clearance items

According to the Polish law, non-refundable items are: services started or provided before the 14 days period for sales agreement renouncement, especially audio and visual records saved on computer data carriers, if the original packaging has been removed by the buyer, services which price depends on the price movement at the financial market, services and items with properties specified by the buyer, that can not be re-sold or that are easily destroyed, outdated, games and bets.

The Complaints, Damages, Mistakes

Because of the nature of the items sold by Anna Grunduls Design, none of the Products are sold with additional guarantees.

Received a damaged product or wrong item? Here’s how to proceed:

  • Let me know about the problem with your order within 3 days from the date of delivery. Nobody’s perfect and mistakes can happen even to the best of sellers. Please send an email to customer-care@annagrunduls.com and enclose clear pictures of the damage/mistake or use the live chat feature on this website (might not work on some devices).
  • You will hear back from Anna Grunduls Design within 7 days. If your request is granted, you will be offered a partial refund, full refund or replacement – I make decisions based on each case separately.

If the item is not compatible with the sales agreement, buyer may request a repair without additional fees or an exchange, unless the repair or exchange are impossible or are associated overly high costs. By the overly high costs judgment, the price and the incompatibility measure are taken into account.

According to Polish law: Ustawa z dnia 27 lipca 2002 r. o szczególnych warunkach ustawy konsumenckiej oraz o zmianie Kodeksu Cywilnego.

When an Order qualifies for a refund, the reimbursement will be sent using the same method that the buyer used in the original transaction. Orders that were paid for using a credit card, will be refunded to the same card.

The Personal Data and Privacy Policy

As a business and admin of annagrunduls.com, Anna Grunduls Design needs to collect and use certain information about individuals – including customers, suppliers, mailing list subscribers and website visitors.

This section describes how this data is gathered, handled and stored to meet data protection standards and also, comply with the law.

The Why

Why this policy exists? For one, it ensures that Anna Grunduls Design complies with data protection law. It’s also here to protects the rights of my customers and website visitors. I’m open about how the data is stored and processed. This policy is also here to protect me (and you) from risks of data breach.

The Policy is written in compliance with the European Data Protection Law (including GDPR) and Polish Constitution. Any personal data will be collected, processed and stored in compliance with these laws.

The Data and What It’s Used For

Various types of data may be collected from individuals vising and interacting with the Anna Grunduls Design website:

  • Usage data:
    When you visit annagrunduls.com, I may collect and process data related to your use of the website. Usage data may include: your IP address, geographical location, browser type, operating system, length of your visit, page views and other information about how, when and how often you interact with the website.

The legal basis for this processing is the company’s legitimate interest, namely the monitoring and improvement of the website and services. This type of data is collected by the website’s content management system as well as Google Analytics. Usage data may also be processed to display advertising, however the ads displayed on this website are under very strict curation, which I explain in more detail in the disclaimers section of these Terms.

  • Account data:
    Anna Grunduls Design processes the information provided by you, when you registered for an account. It may include your name and email address. If you’re a customer, it might also include data such as shipping and billing address or phone number. The data may be used to make placing orders easier, maintain back-up copies of the website, make sure the website is secure or to communicate with you (for example if these Terms change).   Registered users can access and change their account data at the My Account page.

The legal basis for this processing is the account owner’s consent or the performance of a contract, namely Sales Agreement, for example between Anna Grunduls Design and an approved Wholesale Customer. The source of the account data is the account owner or admin who created the account.

  • Order data:
    Anna Grunduls Design may process information from transactions, including purchases submitted via the Shop. This data is for example the buyer’s name, address and contact details. This data is used to fulfill Orders and to keep proper records of the transactions.

The legal basis for this processing is a Sales Agreement between the buyer and seller and the company’s legitimate interests, namely keeping records for tax and maintenance purposes.

  • Mailing data:
    This is the type of data stored if you subscribe to the company’s email newsletter (for example The Happy Colorists Club) or email notifications. It may include your first name and email address.

The legal basis for this processing is your consent (email subscription) or the performance of a contract (for example in case of emails related to your order). The data is collected and processed on my behalf by Flodesk (This is also an affiliate link that gives you 50% off Flodesk, just sayin’).

  • Correspondence data:
    This type of data includes our communications and metadata (for example the date and time of the communications). I’ll use this information to communicate with you about any enquirers or requests and to keep records of our correspondence.

The legal basis for this processing is the company’s legitimate interest, such as proper administration of this website and communication with the users. This type of data is generated by the website’s content management system.

  • In addition to the above reasons, Anna Grunduls Design may process any of this personal data to obtain or maintain business insurance, manage risks or receiving professional advice. I won’t use your information, unless it’s necessary for me to protect my business against risks.

The legal basis for this processing is the company’s legitimate interest, namely proper protection against risks.

  • I hope it doesn’t come to this, however there’s one more situation in which your personal data might be used: it is in case of the establishment, exercise or defense of legal claims – including court and out-of-court procedures.

The legal basis is in this case the protection of the company’s rights, your rights and the rights of other people.

  • There might be additional cases in which any of your personal data is processed, where it’s absolutely necessary – for example to comply with the legal obligations or to protect your (or some else’s) vital interests.
  • As mentioned in the section, where I name all The Bad Things You Cannot Do Here – please do not supply any other person’s personal data, unless it’s necessary or I ask you to do so.

The Information I Share with Others

As I mentioned before, some of your personal data is processed on my behalf by other companies. This includes:

Legal basis for a disclosure of this data is the user’s consent – when you sign up for The Happy Colorists Club or any other email subscription, you will be asked to agree for the use of your data.

Legal basis for a disclosure of this data is the company’s legitimate interest – in this case, the Beeketing system receives information about the first name of the buyer and a list of purchased products. It helps me create live marketing notifications within the website and build customer trust, but don’t worry. I make sure the app never pulls any information that could be used to identify you. The sale notifications only display which products have been purchased at what location.

Legal basis for a disclosure of this data is the participant’s consent. By logging in to the giveaway app and submitting entries, participants agree with their data being processed in ways necessary to run the contest and choose a winner. Each entry is submitted knowingly by the participant and describes possible additional ways of data processing that might be tied to the nature of the entry.

Legal basis for a disclosure of this data is the company’s legitimate interest (providing of customer service) and the customer’s consent. Each chat will be started with a short form including GDPR consent checkbox to ensure that users are aware of their data being processed and transferred.

Legal basis for a disclosure of this data is the company’s lawful obligation, namely accounting and record keeping for tax purposes.

Additionally, I may disclose some of your personal data to insurers and professional advisers, as long as it’s necessary, for example, to manage risks, receive professional business advice or proceed with legal claims in or outside court.

The hosting servers of this website are located within the EEA, however some of the service providers mentioned above store personal data in other countries. Transfers to each of these locations will be protected by appropriate safeguards, approved by the European Commission. I’ll only work with service providers, who protect and transfer your personal data compliant with GDPR rules.

You acknowledge that any personal information you submit for publication on this website (for example by submitting comments or reviews) may be available around the world, via an internet connection. There’s no way for me to prevent the use (or misuse) of such personal data by others.

The Information I Keep or Delete

Personal data that is processed by Anna Grunduls Design is not kept forever. In fact, it’s only kept for as long, as it’s necessary.

I will keep your order data for a minimum period of 5 years following the last day of the year in which you interacted with the website. For example: If you place an order on April 1st, 2018 – your data will be deleted no earlier than on January 1st, 2024.

According to Polish Law: Ustawa o Rachunkowości

Your Usage data will be kept for a minimum of 356 days from the date you last interacted with the website.

In some cases it is not possible to specify the period of how long the data will be kept. The period of retention will be set based on the company’s legal obligations and legitimate interests – such as maintenance of this website.

I may also keep your personal records longer than specified, if it’s to protect your vital interests or the vital interests of another natural person (Unless he or she is a robot, you already know how I feel about those).

The Things You’re Entitled To

Now that we established what personal data I may collect, let’s talk about your rights regarding this, ok?

You have every right to review and correct your personal data. To do this, please reach out to customer-care@annagrunduls.com and present an evidence of your identity. I usually accept a photocopy of your passport and an original copy of a recent utility bill showing the current address. I will not disclose your personal data, unless I’m certain of your identity. If I have reasons to believe that another person is trying to access your data, I may ask for more proof and deny your request if you can’t provide it. I know it’s a lot of steps to take, but that’s really for your own safety.

If your data is currently used for marketing purposes, you can opt out of this type of data processing at any time. In real world, the marketing purposes are usually mailing lists. To opt out of those, simply use the unsubscribe button at the bottom of the email.

You can also request that I delete all records of your personal data. I’m happy to honor the request and will do my best to erase your information, whenever possible, however there are certain situations, when I’m not able to delete all of your information, due to legal obligations. For example, if you have previously placed orders in the Anna Grunduls Design shop, I may be required to keep your personal data for tax purposes.

The Cookies You Don’t Want to Eat

In the internet world, a cookie is nothing especially delicious. It’s a file. 😉 At the top of the file, there is an identifier – a weird looking string of letters and numbers. When you visit this website, a cookie is sent from the server to your browser and the browser keeps the cookie saved. Then, whenever you visit the website again, our server recognizes you by the cookie (actually by the identifier within the cookie file).

There are two types of these electronic cookies – one type is a “persistent cookie” and the other one is called a “session cookie”. Persistent cookies are stored in the web browser until they hit the expiry date set within the file. After the cookies are expired, your browser gets rid of them automatically. Session cookies don’t have set expiry dates. They’re kept in by your browser for one session and once you close the browser – the session cookies are gone.

Cookies usually don’t contain any of your personal data – they identify you as a visitor by the weird string of numbers and letters. Although, some of your personal information stored at Anna Grunduls Design may link to the information stored and obtained by cookies.

The Cookies and Anna Grunduls Design

Anna Grunduls Design uses cookies for:

  • Authentication – to identify you, when you visit the website and navigate it.
  • Login status – to determine, if you’re currently logged in into your account.
  • Personalization – to store information about your preferences and improve your visit on this website. For example: to hide some pop up boxes you already saw.
  • Security – to make sure there are no unauthorized logins into your account and protect the website and provided services in general.
  • Advertising – to display advertising that you’ll find helpful or relevant.
  • Analysis – to analyse how this website is used, how it performs and how I can improve your experience.
  • Online Shop – to save the contents of your cart, if you didn’t get a chance to finalize your purchase or to suggest products you might be interested in.
  • Affiliate Marketing – to track which purchases have been referred by certain marketing partners of Anna Grunduls Design.

Some of my service providers (such as Google Analytics or Flodesk) also use cookies and they can be stored in your browser, when you visit this website.

The Terms and What Happens When I Update Them

The law constantly changes and so does Anna Grunduls Design. Once in a while I have to come back here and update these Terms. This section is here to clarify, what happens when I update them and how does this affect your account and orders.

If you currently have an account at Anna Grunduls Design, you will receive an email notification about any major updates. Don’t worry, I won’t spam your inbox, when I decide to change one small paragraph header or correct a punctuation error. I will let you know about any changes, that could affect your account, your order or your personal data. For example, if I change the way your personal data is stored – you’ll be notified as soon as possible.

What happens if you don’t like the new Terms? If you don’t accept the new Terms, you can request a removal of your account. To do this, reach out to customer-care@annagrunduls.com or reply to the email notification I sent you. Please keep in mind that you will not be able to place any orders in the Shop, unless you accept the Terms.

To place an order in the Shop, you have to accept the current Terms. I enroll new updates spontaneously and it might happen that they change before your order is fulfilled. In this case, the old version of the Terms still applies to your order – the one you agreed to. 🙂
